CHAN MUN FEI

Chan Mun Fei is a partner of the Dispute Resolution Practice of the Firm.

​

Mr. Chan maintains an ardent practice in the areas of commercial and corporate litigation, land and real estate, probate, trusts, banking and securities, insolvency, intellectual property, landlord and tenant, construction, and civil litigation practice. Mr. Chan has advised and represented local and international clients in all the hierarchy of Courts of Law in Malaysia.

Mr. Chan graduated from King's College London with a Bachelor of Laws degree under the King's College London scholarship. He was admitted as a Barrister-at-Law of England and Wales in 2011 upon completing his Bar Professional Training Course with a final grade of Outstanding. He was awarded the Joan Denning Prize and the Buchanan Prize by the Honourable Society of Lincoln's Inn.

Mr. Chan was formerly a partner in Messrs Raja Eleena Siew Ang & Associates and subsequently in Messrs C W Chan & Co before establishing Messrs Chan Lee & Co together with Mike Lee.

Notable Highlights 

​

  • More than 11 years of experience in insolvency practice in acting for both petitioners and respondents in insolvency proceedings including financial institutions, borrowers, developers, judgment creditors and debtors, in the enforcement of debentures and other securities against corporations.

  • Advised and represented major financial institutions in contested and uncontested enforcement of securities under corporate and retail loans and recovery of debts.

  • Acted for a major contractor against a developer in a series of complex land and corporate disputes arising from a failed mixed development project and a restructuring of debts.

  • Advised and represented a creditor in the first-ever reported case in Malaysia pertaining to judicial management under Sub-division 2 Division 8 Part III of the Companies Act 2016 (LEADMONT DEVELOPMENT SDN BHD v INFRA SEGI SDN BHD [2019] 8 MLJ 473).

  • Advised and acted for a public listed company in an action against former directors for breaches of directors’ duties in relation to a foreign investment in border control solutions.

  • Advised and acted for shareholders of a company against a liquidator in relation to the conduct of liquidation and for monies unlawfully applied by the liquidator.

  • Advised and acted for liquidators in actions for disposal of company assets, seeking of directions in the conduct of liquidation, determination of remuneration and other orders pertaining to the liquidation of a company.

  • Advised and represented a supplier of nanotechnology markers for subsidised petrol and diesel in recovery of contractual sums under a government contract.

  • Advised and acted for the beneficiaries of a will to seek an order to terminate a trust and for distribution of assets under a will.

  • Advised beneficiaries of a will made overseas and applied for Grant of Probate in Malaysia in respect such will.

  • Handled a wide array of contractual and commercial disputes, as well as shareholders disputes, construction and CIPAA disputes and disputes involving land, trusts and property.
